$900,000.00 Neglect and Wrongful Death Case Result

An 86-year-old woman attended an adult day health care center a few times per week for over a decade. Adult day health care centers are required to constantly supervise attendees and attendees are not allowed to leave the facility without a staff member. In October 2013, shortly after she was diagnosed with dementia by her doctor, our client walked out of the front door of the facility at lunchtime without staff members noticing. The staff was not paying attention and the person assigned to supervise the front door walked away from her post.

The street in front of the building is a heavily traveled road with several stores up and down the street. Our client walked down the sidewalk and as she tried to cross a side street, a car hit her, knocking her to the ground. Her head hit the pavement, which caused a massive brain bleed. She died three days later. The facility made minimal offers of settlement throughout the case until we started the trial. The case settled on the first day of trial for $900,000.00.
